Prospective spouses may apply together to the Marriage Services Unit of Diyarbakır Metropolitan Municipality regardless of either party’s registered place of residence.

Article 134 of the Turkish Civil Code No. 4721 stipulates that “the man and woman intending to marry must apply together to the marriage registry office.” If the couple cannot be physically present at the time of application, the marriage regulations (Article 17) permit one party to carry out the application through a duly authorised proxy. In such cases, a power of attorney must be prepared; this document must clearly identify both the grantor and the proxy, include the identity details of the person to be married, and explicitly authorise the proxy to complete all marriage formalities.

DOCUMENTS REQUIRED FOR A MARRIAGE APPLICATION

1. MARRIAGE CERTIFICATE BOOKLET FEE: The booklet fee must be paid using the bank details provided below, and the payment receipt must be submitted at the time of application.

2. CERTIFICATE OF CAPACITY TO MARRY: Applicants may obtain their Certificate of Capacity to Marry from our Marriage Registry Office, regardless of their registered place of residence.

3. IDENTITY CARD: The original identity cards and photocopies must be submitted at the time of application.

4. PASSPORT-SIZED PHOTOGRAPHS (4): One photograph is required for the medical report and three must be submitted at the time of application. Photographs must comply with the requirements of the Marriage Regulation, must be in colour and must have been taken within the previous six months. Photographs with a head covering are accepted provided that the forehead and chin are clearly visible.

Photographs in uniform and photocopied photographs will not be accepted.

5. MEDICAL REPORT (WITH PHOTOGRAPH AND OFFICIAL APPROVAL): Provided that both applicants attend the healthcare facility together, medical reports may be obtained from hospitals affiliated with public institutions and organisations, healthcare institutions operating for the public benefit, or family health centres.

Note: A widowed or divorced woman must wait for the statutory period of 300 days before remarrying. If this period has not elapsed, a Family Court decision waiving the statutory waiting period must be submitted.

Applicants who wish to continue using their previous surname together with their married surname after marriage must sign the standard petition provided by our office in accordance with Article 187 of the Turkish Civil Code No. 4721.

LEGAL AGE FOR MARRIAGE

Anyone who has reached the age of 18 may marry without requiring the consent of another person.

A person who has reached the age of 17 must obtain the consent of their legal representative in order to marry. The Legal Representative’s Consent section of the declaration must be signed by the applicant’s parents or guardian in the presence of the neighbourhood head (muhtar), a notary public or an officer at our office. Photocopies of the relevant identity cards must be submitted at the time of application. If either parent is deceased, this must be documented with a detailed civil registration record. The parents or guardian must be present at the marriage ceremony.

A person who has reached the age of 16 must provide a court decision authorising the marriage.

FOREIGN NATIONALS: Foreign nationals must obtain a Certificate of No Impediment to Marriage in Turkish from the consulate of their country and have it authenticated by the Ministry of Foreign Affairs of the Republic of Türkiye. This requirement does not apply in the same manner to apostilled or multilingual documents.

The Certificate of No Impediment to Marriage must include the applicant’s full name, date and place of birth, parents’ names, nationality, passport or identity number, and marital status (single, divorced or widowed, as applicable). For a widowed woman, the date of her spouse’s death must be stated; for a divorced woman, the date of divorce must be stated. Divorced or widowed women must also provide a birth certificate indicating their maiden name. The certificate must include a statement confirming that there is no legal impediment to the person marrying.

All documents are legally valid for six months (180 days).

Requirements for Witnesses – Article 28: A witness must be of legal age and must know the person for whom they are acting as a witness.

(1) A person who clearly appears not to know the party to the marriage may not act as a witness. The witness confirms that the declarations of intent to marry have been made freely, that the identity of the person for whom they are acting as a witness is correct, and that the marriage has taken place.
